These terms are the agreement between you and BodaLedger Technologies ("we", "us") for using the Boda Ledger app. By creating an account or using the app, you agree to them. Please read them carefully. If you do not agree, do not use the app.
1. What Boda Ledger is
Boda Ledger is a record-keeping tool for motorcycle (boda boda) owners in Kenya. It helps you record rider payments, track balances, costs, documents and bike payback, send receipts to riders, and download reports.
Boda Ledger is not a bank, lender, payment service or financial adviser. We do not hold, collect or transfer money. Payments go directly between riders and owners.
2. Who can use it
- You must be at least 18 years old.
- You must give accurate information when you sign up and keep it up to date.
- You may only use one account per person unless we agree otherwise.
3. Your account
- Keep your password private. You are responsible for everything done through your account.
- Tell us straight away if you think someone else has used your account.
- To protect your records, the app logs you out after a period of inactivity. You log in with your email and password to open it again.
- Don't share your password. Anyone who knows it could open your records.
4. Your records and responsibilities
- The records are yours. You own the information you enter about your bikes, riders, payments and costs.
- Accuracy is your responsibility. Balances, reliability scores, reports and receipts are calculated from what you enter. Please check entries before saving, especially amounts, dates and M-Pesa codes.
- Riders' information. You must tell your riders that you record their details and payments in Boda Ledger, only enter information you have a legitimate reason to keep, and follow Kenya's Data Protection Act, 2019. You are the controller of your riders' information; see our Privacy Policy.
- Receipts. Receipts are sent from your own phone by SMS or WhatsApp. Any messaging costs are charged by your mobile network, not by us. You are responsible for the messages you send.
- Disputes with riders. Boda Ledger is a tool to help keep clear records. It does not decide disputes between owners and riders, and we are not a party to your agreement with your riders.
5. Acceptable use
You agree not to:
- Use the app for anything illegal, fraudulent or harmful
- Enter false records to mislead riders, lenders or anyone else
- Enter information about people without a legitimate reason
- Try to access other users' data, break the app's security, or overload it
- Copy, resell or reverse-engineer the app
6. Payment records
To keep records trustworthy, payments cannot be deleted. Mistakes are corrected by editing or cancelling (voiding) a payment with a reason, and every change is kept in the payment's history. This protects both you and your riders.
7. Fees
Boda Ledger is currently free. We may introduce paid plans or features in future. If we do, we will tell you the price clearly before you are charged, and you can choose whether to subscribe. Features you have already been using for free will not start charging you without notice.
8. Availability and changes
- We work to keep the app available and accurate, but it may sometimes be unavailable, for example during updates or due to internet or provider problems.
- We may improve, change or remove features. We will give reasonable notice of major changes that affect you.
- Keep your own backups of important records. You can download reports at any time.
9. Ending your account
- You can stop using the app and ask us to delete your account at any time. Deleting your account permanently removes your records, so download anything you want to keep first.
- We may suspend or close an account that breaks these terms, after giving notice where reasonable.
10. Disclaimers
The app is provided "as is". To the extent allowed by Kenyan law:
- We do not guarantee that calculations, reports or receipts will be free of errors, especially where entries are incomplete or incorrect.
- Payback estimates, reliability scores and similar figures are guides based on your records, not financial advice or guarantees.
11. Limitation of liability
To the extent allowed by Kenyan law, we are not liable for indirect losses, lost profits, or losses caused by incorrect entries, disputes with riders, theft or damage to bikes, or events outside our reasonable control. Nothing in these terms limits any rights you have under the Consumer Protection Act, 2012 or other Kenyan law that cannot be excluded.
12. Privacy
Our Privacy Policy explains how we handle personal data and forms part of these terms.
13. Changes to these terms
We may update these terms. We will tell you in the app or by email before important changes take effect. If you keep using the app after that, you accept the updated terms.
14. Governing law
These terms are governed by the laws of Kenya. If a dispute cannot be settled by talking to us first, it will be handled by the courts of Kenya.
